On 16 April the Supreme Court gave its judgment in the appeal of For Women Scotland v Scottish Ministers, ruling that a Gender Recognition Certificate does not change a person’s legal sex for the purposes of the Equality Act 2010.
The judgment is technical and relates specifically to the interpretation of the Equalities Act where there are specific targets for equal representation and, as acknowledged by the Equality and Human Rights Commission (EHRC), to single-sex services under some circumstances. EHRC has committed to reviewing its code of practice and advice. Once these are revised, we will publicise any changes to members.
